Dear Customer,
Thank you for choosing DualPicks.
In accordance with Legislative Decree 206/2005, as subsequently amended and supplemented—most recently by Law 214/2023—and with Legislative Decree 70/2003, we hereby provide the General Terms and Conditions of Sale that govern the sale of products through the websites www.dualpicks.it and www.dualpicks.com, both owned and managed by Seeft di Bufarini Simone (VAT No. 02983090420 – Tax Code BFRSMN92T23E690H), a sole proprietorship under Italian law, with registered office in Jesi (AN), Via Ponte Pio no. 6, certified email: simone.bufarini@pec.it.
These terms govern the contractual relationship between, hereinafter referred to simply as "DualPicks" (a patented product and registered trademark), and its customers.
Please read these Terms and Conditions carefully before making any purchase, as completing a purchase will imply full acceptance of these conditions.
Please note that DualPicks does not sell products to individuals under the age of eighteen. By accessing www.dualpicks.it or www.dualpicks.com, you declare that you are of legal age.
Users under 18 may browse the websites freely but must involve a parent or guardian to make a purchase.
1) Information Provided for Your Protection
These Terms and Conditions aim to provide customers with clear and understandable information regarding:
a) The main characteristics of the goods, as described on the dedicated product pages, before you finalize your purchase;
b) The seller’s identity, including the geographical address of DualPicks' headquarters, phone number, standard email, certified email address, and the contact point for complaints;
c) The total price of the goods including taxes, or if the nature of the goods prevents a reasonable prior calculation, the method of price calculation, as well as any additional costs for shipping, delivery, or postal charges, or a notice that such charges may be applied;
d) Payment methods, shipping and execution details, estimated shipment dates, and complaint management procedures;
e) The conditions, terms, and procedures for exercising your right of withdrawal under current regulations;
f) Information on any return shipping costs if the goods cannot normally be returned by mail;
g) How to submit a withdrawal request, including any related costs for which the customer will be responsible;
h) Information regarding the existence of the legal warranty of conformity for goods and details on after-sales support services and commercial guarantees;
i) The option to request a copy of the digital documents related to the purchase;
l) The possibility of using an out-of-court complaint and redress mechanism to which DualPicks adheres and the conditions for accessing it.
2) Nature of the Contract
The presentation of products on the websites www.dualpicks.it and www.dualpicks.com constitutes an invitation to offer.
If you wish to purchase one or more products, you can select them one at a time and add them to your shopping cart.
Once you have selected all the items you wish to purchase, you can confirm your cart and submit your order.
At this point, a summary page will appear, displaying:

A list of selected products;
-
Quantity selected for each product;
-
Individual product prices and available shipping options (with corresponding costs);
-
A prompt to choose your preferred shipping, transportation, and payment method among those available.
At the bottom right of the cart page, you will find the "proceed to payment" button.
By clicking it, you finalize your order, implying an obligation to pay and confirming your purchase, subject to the right of withdrawal described in Section 3.
Your order will then be treated as a contractual offer made to DualPicks to purchase the listed products individually.
Upon receipt of your order, DualPicks will send you an acknowledgment email—"Order Confirmation"—from the address info@dualpicks.com, including the payment receipt according to the method you chose.
Any other communication from a different account will not be considered a valid Order Confirmation.
The sales contract will be considered finalized only when you receive the "Order Confirmation," which will detail:

A summary of the products purchased (description, code, quantity, and price);

Shipping method for the purchased products;
-
Expected shipping date.
If your order is processed through multiple shipments, you may receive separate Order Confirmations.
You can cancel your order before receiving the Shipping Confirmation, provided that the order has not yet entered the shipping process.
In that case, you will not incur any charges.
You agree to receive invoices electronically, which will be sent by email from info@dualpicks.com.
3) Right of Withdrawal
Subject to the exceptions outlined in Section 6 and provided you qualify as a Consumer Customer, you have the right to withdraw from your order within fourteen (14) days without providing any reason and without incurring any costs other than the return shipping fees.
The fourteen-day withdrawal period begins:

From the day you or a third party indicated by you, other than the carrier, physically acquires possession of the purchased good;

In the case of multiple goods ordered in a single order and delivered separately, from the day you acquire possession of the last good;

In the case of goods delivered in lots or multiple pieces, from the day you acquire possession of the last lot or piece;
-
In the case of periodic delivery contracts, from the day you acquire possession of the first delivered good.
To exercise your right of withdrawal, you must notify DualPicks of your decision according to the instructions provided, preferably using the withdrawal form available on our website.
The communication of withdrawal must be made before the fourteen-day withdrawal period expires, and the product must be returned to the address provided by DualPicks in the response email following your withdrawal notice.

4) Obligations of DualPicks Following the Exercise of the Right of Withdrawal
If you exercise your right of withdrawal according to the prescribed procedures, DualPicks will promptly send you a confirmation of receipt of your withdrawal request.
The burden of proof regarding the exercise of the right of withdrawal lies with you.
DualPicks will refund all payments made by you related to the returned product(s), including any standard shipping costs (but excluding any additional charges for choosing a more expensive delivery method), without undue delay and in any event no later than fourteen (14) days from the day it is informed of your decision to withdraw.
Refunds will be made using the same payment method you used for the original transaction, unless you have expressly agreed otherwise.
Unless DualPicks has offered to collect the goods directly, it reserves the right to withhold the refund until it has received the goods or until you have provided proof of having returned them, whichever occurs first.
If you are a non-consumer customer, the return must be accompanied by an appropriate Transport Document (DDT).
5) Obligations of the Consumer in the Event of Withdrawal
You must return the goods or hand them over to DualPicks, or to a third party authorized by DualPicks to receive them, without undue delay and in any case within fourteen (14) days from the date on which you communicated your decision to withdraw.
The direct cost of returning the goods is your responsibility.
Please note that if you chose a delivery method at the time of purchase that was more expensive than the standard delivery method offered by DualPicks, you will not be refunded the additional shipping costs.
Aside from the direct costs of returning the goods, exercising your right of withdrawal will not result in any other charges or liabilities.
Returned products must be delivered intact, together with all related informational and fiscal documents, including the warranty certificate if present.
If the informational or fiscal documentation is missing or unusable, DualPicks will not be able to process the refund.
You will be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
In the event of damage during transport, DualPicks will notify you within five (5) business days from receipt of the goods, allowing you to file a timely claim with the carrier of your choice and obtain reimbursement for the value of the goods (if insured). In this case, the product will be made available for return, and the withdrawal request will be canceled.
DualPicks is not liable for any damage, theft, or loss of returned goods that are shipped uninsured.
Return shipping costs and risks are entirely your responsibility, and no compensation will be provided by DualPicks for lost or damaged goods.
6) Exceptions to the Right of Withdrawal
The right of withdrawal is excluded in the following cases:

Goods made to measure or clearly customized;
-
Sealed goods that are not suitable for return for hygiene or health protection reasons and that have been opened after delivery;
-
Goods which, by their nature, are inseparably mixed with other goods after delivery.
Returns will not be accepted if the product is returned without its original packaging and accessories.
7) Shipping, Prices, Availability, and Transfer of Risk
7.1 Shipping Terms
Unless otherwise agreed in writing by the parties, DualPicks undertakes to deliver the goods without undue delay and in any case no later than thirty (30) days from the date of sending the Order Confirmation.
The shipping obligation is considered fulfilled when material availability or control of the goods is transferred to you or your designated representative.
If DualPicks fails to deliver within the stated time frame, you are entitled to set an additional deadline, not shorter than fifteen (15) days.
If DualPicks still fails to deliver within this additional period, you have the right to terminate the contract and obtain a full refund without undue delay.
If you are not a Consumer Customer, delivery will be made according to Incoterms 2010 (or 2020 where applicable).
In case of delays not attributable to DualPicks, no compensation will be due.
Shipping insurance is subject to general Incoterms rules, but optional insurance can be requested and will be quoted separately by writing to: help@dualpicks.com.
7.2 Prices
All prices are inclusive of VAT where applicable.
Despite our best efforts, errors in pricing may occur. DualPicks will verify the prices before dispatching the order.
If the correct price is higher than that stated, DualPicks will contact you to confirm if you still wish to purchase the product at the correct price. Otherwise, the order will be canceled.
If the correct price is lower, DualPicks will charge the lower price and proceed with shipping.
7.3 Availability
Product availability is indicated on the website on each product page.
Estimated shipping and delivery times are purely indicative and cannot be relied upon as guaranteed.
If items you ordered are unavailable, DualPicks will notify you by email.
7.4 Transfer of Risk
After receiving the Order Confirmation, the risk of loss or damage to the goods (for causes not attributable to DualPicks) passes to the Customer only when they, or a designated third party, physically take possession of the goods.
If you selected a carrier not proposed by DualPicks, the risk transfers upon delivery of the goods to the carrier.
8) Customs Duties
If the products you order are to be delivered outside Italy and/or the European Union, they may be subject to import duties and taxes, which are applied once the package reaches the destination.
Any additional customs clearance costs will be your responsibility.
DualPicks cannot predict or control these costs as they vary by country and cannot be calculated in advance.
Before placing an order, you are advised to check with your local customs authority for information on applicable duties and taxes.
Please note that when ordering from www.dualpicks.it or www.dualpicks.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.
By reading and accepting these Terms and Conditions, you acknowledge that cross-border deliveries may be subject to inspection by customs authorities.
9) Warranty for Products Sold by DualPicks
The warranty coverage for products sold by DualPicks varies depending on whether you are classified as a Consumer under Italian Legislative Decree 206/2005 and EU Directive 2019/771/EU.
If you are a Consumer, you are entitled to a legal guarantee of conformity for all goods purchased, covering defects existing at the time of delivery for a period of two (2) years.
Products are considered to conform to the contract if, where applicable:
a) They are suitable for the use for which goods of the same type are normally used;
b) They conform to the description made by DualPicks and possess the qualities shown on the website or sample models;
c) They present the quality and performance that are normal for goods of the same type, taking into account the nature of the product and any public statements made by DualPicks or the manufacturer, including advertising and labeling;
d) They are fit for any specific purpose requested by the Consumer and accepted by DualPicks.
There is no lack of conformity if, at the time of contract conclusion, the Consumer was aware of the defect or could not reasonably have been unaware of it.
In the event of a lack of conformity, you are entitled to have the product brought into conformity free of charge by repair or replacement, or, if that is impossible or excessively burdensome, to a price reduction or contract termination.
You may choose between repair and replacement unless one option is objectively impossible or excessively costly compared to the other.
The repair or replacement will be carried out within a reasonable time and without causing you significant inconvenience.

You are entitled to request a price reduction or termination of the contract if:

Repair and replacement are impossible or excessively costly;
-
DualPicks has failed to remedy the defect within a reasonable period;
-
The repair or replacement caused significant inconvenience.
The reduction or refund amount will take into account the use made of the product.
Minor conformity defects that make repair or replacement excessively burdensome do not entitle the Consumer to terminate the contract.
10) Terms of Responsibility for DualPicks and Customer Duties in Case of Non-Conformity
DualPicks is responsible for any conformity defects that appear within two (2) years from the date of delivery of the goods.
You must report any conformity defect within two (2) months from the date you discovered it.
Reporting is not required if DualPicks has acknowledged the defect or concealed it intentionally.
Unless proven otherwise, it is presumed that conformity defects appearing within six (6) months of delivery already existed at the time of delivery, unless incompatible with the nature of the goods or the defect.
You must always retain the purchase receipt and any delivery documents for warranty claims.
If you discover a defect in a product purchased from DualPicks during the warranty period, please contact us at dualpicks.com/pages/contact.
To the extent permitted by law, DualPicks disclaims all liability if the product delivered does not comply with the laws of a country outside Italy.
DualPicks is not responsible for delays in delivery due to supplier stock shortages.
DualPicks is not responsible for minor differences between the goods and the images and descriptions published on the websites www.dualpicks.it and www.dualpicks.com.
Except in cases of willful misconduct or gross negligence, DualPicks' liability is limited to direct and foreseeable damages at the time of contract conclusion.
DualPicks is not responsible for any indirect losses, loss of profit, or damages not directly and immediately resulting from its breach.
DualPicks is not responsible for third-party obligations (e.g., manufacturer warranties).
For each conformity defect reported, a case will be opened in your name, and a repair or replacement authorization code will be issued.
In case of product replacement, the defective item must be returned to DualPicks within 30 days from the notification of the shipment of the replacement.
11) Amendments to the General Terms and Conditions of Sale
DualPicks reserves the right to modify the www.dualpicks.it and www.dualpicks.com websites, as well as these General Terms and Conditions of Sale, at any time.
Such changes will not affect orders that have already been confirmed and shipped but will apply only to purchases made after the changes have taken effect.
Updates may be made to introduce new products, update prices, or comply with legislative or regulatory changes.
12) Severability Clause
If any provision of these General Terms and Conditions of Sale is found to be invalid, void, or unenforceable for any reason, such provision shall not affect the validity and enforceability of the remaining provisions.
Any tolerance by DualPicks of non-compliance with these conditions does not constitute a waiver of the right to act against the Customer for breach of contract.
13) Governing Law – Online Dispute Resolution (ODR)
These General Terms and Conditions of Sale are governed by and must be interpreted according to Italian law, specifically the Italian Consumer Code (Legislative Decree 206/2005, as subsequently amended) and Legislative Decree 70/2003.
By making a purchase, you accept the exclusive jurisdiction of Italian courts.
However, if you are a Consumer Customer, you may bring proceedings before the competent courts of the EU Member State in which you reside.
The Italian Competition Authority (AGCM) also acts as a competent authority for consumer rights protection.
The possibility to resolve disputes through out-of-court means is encouraged, including mediation centers and the European Commission's Online Dispute Resolution (ODR) platform available at:
